Terms of Service

The terms and conditions that govern your engagement with ISS Investigations.

1. Acceptance of Terms

By contacting, engaging, or using the services of ISS Investigations (“ISS”, “we”, “our”, “us”), whether through this website, telephone, WhatsApp, or written correspondence, you agree to be bound by these Terms of Service. If you do not agree, you should not engage our services.

These terms are governed by the laws of the Republic of South Africa and any dispute will be subject to the jurisdiction of South African courts.

2. Nature of Our Services

ISS Investigations provides professional private investigative services including, but not limited to:

  • Corporate investigations: fraud, misconduct, due diligence, and business risk
  • Surveillance: lawful observation and field reporting
  • Financial investigations: asset tracing and fraud indicators
  • Legal support: witness location, evidence gathering, case chronology
  • Domestic matters: family, personal safety, and infidelity investigations
  • Insurance reviews: claims verification and fraud prevention

All services are provided subject to scope agreement, applicable South African law, and PSIRA regulations.

3. Engagement and Mandate

An investigation mandate is formally established through:

  • A signed mandate or service agreement
  • Payment of a retainer or deposit as agreed
  • Written confirmation of scope, deliverables, and timelines

ISS reserves the right to decline any mandate at our discretion, including where the requested service would be unlawful, unethical, or contrary to PSIRA regulations.

Verbal instructions or WhatsApp communications do not constitute a formal mandate unless confirmed in writing by ISS.

4. Lawful Operations

All investigative activities conducted by ISS comply with South African law, including:

  • The Private Security Industry Regulation Act (PSIRA Act 56 of 2001)
  • The Protection of Personal Information Act 4 of 2013 (POPIA)
  • The Electronic Communications and Transactions Act 25 of 2002
  • Common law rights of privacy and dignity

Clients may not instruct ISS to conduct activities that would constitute a criminal offence, breach of privacy law, or violation of any person's constitutional rights. Any such instruction will result in immediate termination of the mandate.

5. Client Obligations

By engaging ISS, you warrant and agree that:

  • All information provided to ISS is accurate and complete to the best of your knowledge
  • You have a lawful basis for requesting the investigation
  • You will not use investigative findings for any unlawful purpose
  • You will keep all ISS methods, operators, and operational details strictly confidential
  • You will comply with any applicable laws when acting on investigative findings

6. Confidentiality

ISS operates under strict confidentiality obligations. All information shared by the client and all findings produced by ISS are treated as confidential.

ISS will not disclose client information or investigation details to any third party unless:

  • You have given explicit written consent
  • Disclosure is required by a court order or applicable law
  • Disclosure is necessary to prevent serious harm or criminal activity

Clients are equally obligated to maintain the confidentiality of ISS operational methods, personnel, and investigative techniques.

7. Reporting and Findings

ISS will provide investigation findings in the form of a written report unless otherwise agreed. Reports are:

  • Factual and based on evidence gathered during the investigation
  • Prepared with legal proceedings in mind where relevant
  • The intellectual property of ISS until full payment is received

ISS does not guarantee specific outcomes or findings. The nature of investigations means results are dependent on available evidence and lawful access to information.

8. Fees and Payment

Our fees are structured as follows:

  • An initial retainer is required before any investigation commences
  • Fees are quoted on a per-matter basis based on scope and complexity
  • Disbursements (travel, surveillance equipment, database access) are billed at cost
  • Invoices are payable within 7 business days of issue unless otherwise agreed
  • Late payment may result in suspension of services

9. Limitation of Liability

To the maximum extent permitted by law:

  • ISS is not liable for any indirect, consequential, or incidental loss arising from the use of our services
  • Our total liability for any claim is limited to the fees paid for the specific mandate in question
  • ISS is not liable for outcomes of client decisions made based on investigative findings
  • ISS does not warrant that all information or evidence obtained is complete or exhaustive

Nothing in these terms limits liability for gross negligence, fraud, or wilful misconduct by ISS.

10. Termination

Either party may terminate a mandate by giving written notice. Upon termination:

  • ISS will cease all investigative activities immediately
  • Any work completed to the point of termination will be billed at the applicable rate
  • Retainer funds will be reconciled against work completed — any surplus returned per our Refund Policy
  • All confidentiality obligations survive termination

11. Website Use

This website is provided for information purposes. You may not use this website to:

  • Distribute unlawful, defamatory, or misleading content
  • Attempt to access restricted areas or disrupt site functionality
  • Harvest contact information for unsolicited communications
  • Impersonate ISS or any of its personnel

All website content is the intellectual property of ISS Investigations and may not be reproduced without written permission.

12. Changes to These Terms

We reserve the right to update these Terms of Service at any time. The version published on this page is the current version. Continued engagement with ISS after an update constitutes acceptance of the revised terms.
